Breathe Gathering Force Majeure Disclaimer

Breathe Gathering recognizes that unforeseen circumstances beyond our control may arise that could affect the planning and execution of the festival. In such instances, Breathe Gathering reserves the right to modify, postpone, or cancel the event without liability, subject to the terms outlined below:

1. Definition of Force Majeure: “Force majeure” refers to any event or circumstance beyond the reasonable control of Breathe Gathering, including but not limited to natural disasters, acts of God, government regulations, civil unrest, terrorism, labor disputes, and unforeseen health crises.

2. Modification, Postponement, or Cancellation: In the event of force majeure, Breathe Gathering may, at its discretion, modify the festival schedule, postpone the event to a later date, or cancel the event entirely. Such decisions will be made with the safety and well-being of attendees, staff, and performers as the primary consideration.

3. No Liability for Damages: Breathe Gathering shall not be liable for any damages, losses, expenses, or inconvenience incurred by attendees as a result of modification, postponement, or cancellation of the festival due to force majeure. This includes, but is not limited to, travel expenses, accommodation costs, and ticket fees.

4. Refunds and Ticket Transfers: In the event of cancellation due to force majeure, Breathe Gathering will make reasonable efforts to provide refunds to ticket holders. However, Breathe Gathering reserves the right to withhold refunds or offer ticket transfers to a rescheduled event, as determined by the circumstances of the force majeure event.

5. Communication of Changes: Breathe Gathering will communicate any modifications, postponements, or cancellations resulting from force majeure through its official website, social media channels, and email newsletters. Attendees are encouraged to stay informed of updates and changes to the festival schedule.

6. No Legal Recourse: Attendees acknowledge that force majeure events are beyond the control of Breathe Gathering, and therefore, they waive any claims or legal recourse against Breathe Gathering arising from such events.

7. Continued Cooperation: Attendees are requested to cooperate with Breathe Gathering and follow instructions provided by festival organizers and staff in the event of force majeure.
